America's Vancouver Ted Gathe and Joshephine Townsend Scewed Up


Firing Lying
As calls for investigation into a Vancouver cop’s firing mount, so does evidence the city screwed up.

The city of Vancouver, Wash., had good reason to disregard the complaint that led to Officer Navin Sharma’s firing—and to the city ultimately paying Sharma a $1.65 million wrongful discharge settlement.

As federal officials ponder a recent call by Vancouver Mayor Royce Pollard and police union officials for an investigation into Sharma’s firing (see “Good Cop, Mad Cop,” WW, July 30, 2008), abundant evidence that the process was deeply flawed is already part of the court record.

The big flaw dates back to Feb. 16, 2005, when court records show, longtime Vancouver City Attorney Ted Gathe drafted a letter of termination for the city’s chief prosecuting attorney, Josephine Townsend.

“I have met with you on several occasions to discuss my concerns regarding your performance,” Gathe wrote Townsend in a letter that began “re: Termination of Employment.” “Throughout your employment in the position of Chief Prosecuting Attorney, I have felt the need to repeatedly counsel you on this subject.”

Gathe’s letter detailed several concerns. But the most damning, contained in his handwritten notes, are two judges’ doubts about Townsend’s “truthfulness.” Gathe says Townsend resigned rather than be fired.

Townsend then entered private practice and in February 2006 complained to Gathe’s office about drunken-driving tickets written by Sharma.

When she was working for the city, Townsend had worked closely with Sharma, helping him improve the effectiveness of his ticket-writing. Now she wanted to use what she knew about Sharma against him.

Gathe’s office passed the complaint to VPD internal affairs whose investigation consisted of interviews with Sharma and two Washington State Patrol DUII experts, who found nothing seriously wrong with Sharma’s tickets. None of the more than two dozen Vancouver police officers who approved Sharma’s tickets was interviewed.


The court record shows Gathe’s subordinates were involved at every step of the process that followed: reviewing the investigation and helping write his termination letter.

Even more remarkably, those subordinates asked the Clark County District Attorney’s Office to consider charging Sharma with felonies for what even his superiors acknowledge were unintentional cut-and-paste errors. They then effectively ended Sharma’s law enforcement career by sending out so-called “Brady notices” to 90 members of the Clark County bar, informing them that Sharma could no longer be trusted to testify truthfully in court.

So, put another way, Gathe oversaw the destruction of Sharma’s nine-year career based on the complaint of an ex-employee he was prepared to fire for cause, and who was ethically bound not to use what she had learned while working for the city against the city or its employees.

“I’m saddended that the city attorney’s office, which I trusted, conspired to rob me of the career I loved,” Sharma says.

Gathe defends his actions.

“The fact that the initial complaint came from Josephine Townsend was irrelevant,” he says. “Regardless of whether there were or were not issues regarding Ms. Townsend’s credibility…the decision to further investigate her allegations was reviewed by several individuals of my office as well as [Sharma’s superior].”

Nonetheless, last month Vancouver agreed to pay $1.65 million to Sharma, a Portland resident now working as a Providence ER nurse, what Jury Verdicts Northwest says is the largest employment settlement in Northwest history. -- Nigel Jaquiss, Willamette Week

PLEASE, DO NOT TELL US, Mayor Pollard, City Manager McDonnell, the Ted Gathe, City District Attorney and VPD Management are innocent. All these men have been elected and hired to manage, supervise and lead the city's most important departments. Right now, today! They are the individuals we trust to make the right decision on our behalf and govern our City.

For nearly two years ALL of these men had the opportunity to have corrected a wrong done by their colleagues. If they were such wonderful and caring individuals who have spent their precious lives and careers trying to do good for the City, it would not have cost us a 1.65 million dollar settlement for a wrongful termination, a bogus IA investigation, compounding lies and continued corruption cover-ups.

Now, you add an angry, manipulative, conniving, deceitful two-faced woman to the pot of corruption and cover-ups - someone should hold her accountable and she should pay the City back the 1.6 million.

Besides me, anyone else interested to know what she did or how she convinced Ted Gathe to roll over and give her such a glowing reference that guaranteed her a position as a Washington state administrative law judge after drafting a termination letter for poor work performance. Even after two judges’ declared their doubts and concerns about Townsend’s “truthfulness.”

HELLO People, RED FLAG, RED FLAG!Anyone else have a concern and issue with this besides me?

I am optimistic the WA Bar Association is smart enough to begin their own investigation of the Sharma case in light of all the evidence and allegations against Judge Townsend and DA Gathe.

And I also anticipate that Judge Townsend will join her other “Baloney Eating” colleagues in Orange.

First of all, I'd like to applaud the fine women and men of the Vancouver Police Department line staff for their hard work and dedication.

I'd like to say that, though many may wish not to live in the past and move on, it would not only be negligent, irresponsible, enabling, and perhaps criminal, to not deal with the past and hold those acountable as deemed appropriate by a trustworthy, competent, legal authority. We can't look away from the damages that the City officials and VPD Admin has done, although we may want to.

This, clear example of abuse of political authority needs to be checked. We no longer have a system of checks and balances, where not only the citizens, but also the employees, can trust that the right thing would be done in situations such as harassment, retaliation, nepotism, etc. In any organization, one can expect a few issues or problems to arise, but also expect that they would be dealt with properly. That is normal.

What is abnormal, is for an organization, such as the Vancouver Police Department's Administration, to have manifested an environmental so careless and hostile, that their employees fear speaking their opinions, or concerns, for fear of retaliation. They 'over-discipline' good employees who make minor errors and use them as 'examples', yet 'under-discipline' the trouble makers, promote them and put them in positions of authority to further their evil ways upon others.

You should ask the City of Vancouver Human Resources about the many city wide employee complaints aout their employers, and ask what the outcome of each were. One complaint, by Rolando Hernandez, resulted in a 9th United States Circuit Court of Appeals opinion that the City of Vancouver and Hernandez's supervisor, conspired to cover up a race based investigation. This 9th Circuit Court ruling was April 14, 2008, yet nothing has been mentioned about this... .... yet.

Hey Sam -- Why don't you mention the Mr. Hernandez suit :-)

Most of the places I've worked at HR is for the company -- not the humans. HR is not responsible for identifying systemic problems, they are just responsible for identifying problems with employee's.

Does anyone know who is responsible for starting an IA within the PD? That's something I need explained.

I would want to see actual examples of Sharma's "cut and paste" efforts before making any conclusions.

My impression is that if I was the one cited or arrested how he did this could be extremely important.

If I was in a business serving liquor, what is written in these reports could cause problems with WSLCB or OSLCB not to mention lawsuits that could bankrupt and put my family and employees on the streets.

"Cut and paste" does not lead to justice ...

I have seen first hand how much Vancouver is screwed up. I'm not that smart of a man but I know we have a right to due prosses. Vancouver judge kelly osler former majors crimes is very steroids type on men. I went up in front of her so one sided. A real open and shut case. I showed the courts that the person committed perjury and the judge admitted to the perjury but ruled in favored of other party . Y I don't know then I find out that her mom was high ranks in the city. Thenthe townsin steps in lie and planting evadence.
I'm a working single dad I don't have money or time to fight the law. I rather move out of town and hop that carma find them
